CHILDREN KIDNAPPED to l'Argentina

It is a well-known fact that when a couple from two different countries or cultures divorce, the one who must submit to
the foreign jurisdiction often feels at a great disadvantage. The strong feeling that his or her rights as a parent have not
been respected as they would have been in the country of origin, pushes that person towards a rejection of everyone
and everything having to do with the foreign country. Whether or not that person admits to any faults, he or she rejects
the decision of the foreign court and considers him self or herself to be its victim.

The Facts:

1. The mother and the maternal grandmother (who was visiting her grandchildren), left Madrid (usual residence since
1988) for "holidays" and with the  intention to introduce Renata (13 months old at that time) to the martenal family living
in Argentina, while the father was abroad for business. Tomás, mental handicapped, was receiving special medical
care at "La Paz Hospital" (Madrid) and also special education.

2. Before leaving, the mother with the help and complicity of her mother, taking advantage of her husband absence,
"cleaned up" the bank accounts they had in common and prepared the moving of furniture, clothes, a fully equipped
dental cabinet, etc to Argentina. She also took her husband's diplomas and other certificates. She took about $US
60'000 in cash and about $US 30'000 in furniture.

3. In March 1995 the father learnt that his children went to Argentina with a one-way flight ticket and realised that the flat
was empty.

4. In April 1995 the father went to Argentina (risking to lose his job) to see his children who were by their maternal
grandparents and to know the reason why his wife abandoned Madrid.

5. The mother hides the children and avoids the father and his family (who lives also in Argentina) all contact with them.
At the same time she demands a monthly rate of US$ 4000.--, a car and the renunciation of having the custody of the
children as conditions to get the "right" to see them at least. You can imagine the father's anguish as he heard his
children crying behind the door.

6. The father can only give in to such an ignoble blackmail and went back to Spain where a denounce was placed at the
National Police and also a demand for divorce and the custody for the children. Numbers of trials without any success
have been made to get in contact with the mother and her family. At the end in May 1995 the children disappeared from
their fix residence in La Plata (70 N°, 343 - 1900 La Plata, Argentina).

7. Although the judge of the Court of First insistence of Torrejon de Ardoz (Madrid) declares himself competent, he
refuses the Convention of Den Haag, of which Spain and Argentina are signatories.

8. During almost 2 years, the Spanish authorities were looking for the mother's new residence in Argentina. Finally they
were found in Cutral-Co, Neuquen, Patagonia at one of the ex wife's brother, also him accomplice.

9. The mother sends an attorney-at law to Spain who takes a representative there to dispute on the last day of the delay
given by the Spanish Justice before taking a decision.

10. The mother laughs at the Argentinean Justice (She already answered to the Spanish Justice) in establishing a legal
action demanding a pension from the paternal mother who also lives in La Plata at only 500 m of distance, under the
pretext of the father's disappearance !!!!!!

11. In addition to all that there is no prove that the son, Tomas, is under medical treatment or is going to school.

12. A new judge is taking the trial in Spain and after a normal proceed and a new demand of documents, and the
questioning of the father and witnesses, the judge declares himself incompetent in May 1998, after 3 years !!!!!!! and this
to close the case. Appeal is made immediately after to the Supreme Court.

13. During 2 years the father and his family in Argentina make several publications in different Argentinean newspaper
in placing adverts of message of love and hope for the children.

14. A part from that the paternal grandmother agrees to a pension with the hope to see again her grandchildren after 3
years.

15. The mother maintains that the children belong to her and only with her they can do well.

16.    10th of March 1999, the Spanish Central Authority for The Hague Convention has requested to the Argentinian authorities to return Tomas and Renata to Spain.

This is a modern form of torture, the effects of which, while not comparable to physical torture, are nonetheless
devastating, both immediately and in the long term, to the children's development, their image of their father, and their
view of men.

It will be very difficult to change the false idea that Tomás and Renata are being given that the world is a dangerous
place, that the law is the enemy, and that men are a threat to children and women.

We must not forget as well the pain and desolation of the father's family in Argentina, living in the same area !. As much
as the father has tried to guarantee the parents of his former wife that they will see Tomás and Renata, still they are
opposed to children's visiting their other grandmother.
 
 

WHO COULD BELIEVE THAT A DENTIST LIKE THIS WOMAN:

1. Is using her handicapped son to extort money?

2. A health professional like her is unable to insure basical treatments indispensable for her mental handicapped son?

3. Is making her children think that their father had abandoned them?

4. Told her children that even her father's family in Argentina had abandoned them?

5. Avoids her little daughter, 5 years old, to have any contact with her father for 4 years?! Her father is already a stranger
for her.

6. That she pursues a course of harassment against her ex-husband and his family that amounts to psychological torture
and forces her children to take part?
